(a) If it shall find that such plan meets the requirements of this Ordinance, it shall approve the same as the final development plan. (b) If it shall find that upon said plan being amended, altered and changed as specified by the Commission, it will meet the requirements of this Ordinance, it shall so notify the applicant. Thereupon the applicant shall prepare and file with the Commission a final development plan and supporting data incorporating such specifications. Upon the filing of a final development plan complying with the specifications of the Commission, the Commission shall approve the same and so notify the Zoning Administrator. (c) If it shall find that such plan does not comply with the requirements of this Ordinance and is not susceptible of alteration, change or amendment to meet such requirements or if the applicant fails to file such requirements, or if the applicant fails to file a final development plan in compliance with subsection 11 hereof, the Commission shall disapprove the same. In the event that the developer or owners of the real estate desire to modify or amend the approved development plan, and if the Zoning Administrator feels that the modification or amendment warrants Commission action, the Commission may review and approve an amended or modified development plan. In the event the conditions of the development plan approval are not met or maintained those approved conditions shall constitute a zoning violation and the penalty provisions of the Ordinance shall apply_ (4) DRIVE-IN FACILITIES PLANNING POLICY In determining the approval or disapproval of a proposed development plan and supporting data, the Commission will be guided by the adopted planning policy for drive-in facilities as set forth below. These policies are intended to suggest minimum standards of aesthetic suitability and to suggest minimum standards of site location, size and development to insure the safe and efficient operation of the drive-in facilities in Allen County.
