25 The answer is due within ten (10) days aHel· service of the amended complaint. (2) Motion for enlargement of time; continuance. When an act is required or allowed to be done at or within a specified time by these rules, the Convnission may at any time for cause shown: (a) Order the period enlarged, wilh or without notice, if request therofore is made before expiration of the period originally prescribed or extended by a previous order; or (b) Upon motion made after the expiration of the specified period, permit the act to be done where the failure to act was the result of excusable neglect. (3) Motion for dismissal; lack of jurisdiction. To save the expense of unwarranted investigation and litigation, the Commission will entertain, at any time, a motion to dismiss for the reason that the complaint, on its face, fails to allege a faclual basis which, if true, would viol ate one of the duties or prohibitions enumerated by the Ordinance, or because the situs of the discrimination is outside the territorial Jurisdiction of the Commission. The motion shall be specific. The Chair or lIearinl{ Officer may order a Rtay of proceedings when such motion is filed.
